Arkana Tech provides AI-powered solutions for businesses, including but not limited to:

• Voicebots — AI-powered voice agents for automated phone call handling and response.
• Automations — Workflow automation solutions connecting business tools and processes.
• Custom Applications — Bespoke software applications built to address specific business needs.

Our website also features an AI chat assistant for lead qualification and appointment scheduling. This assistant collects information about your business to facilitate an initial consultation with our team.

Specific deliverables, timelines, pricing, and scope of work for client engagements are defined in separate written agreements (Statements of Work or Service Agreements) executed between Arkana Tech and each client.

3. Eligibility

To use our services, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into binding agreements.
• Not be barred from receiving services under applicable law.
• If acting on behalf of a company or organization, have the authority to bind that entity to these Terms.

4. Use of the AI Chat Assistant

Our website includes an AI-powered chat assistant. By using it, you acknowledge:

• The assistant is designed to collect lead information and schedule consultations. It does not provide legal, financial, medical, or professional advice of any kind.
• Responses generated by the AI are automated and may not always be accurate, complete, or current. Always verify important information with a qualified human representative.
• The assistant does not create binding contracts or commitments on behalf of Arkana Tech. Any project engagement requires a separate signed agreement.
• Meetings scheduled through the assistant are subject to confirmation and availability from our team.
• You must not use the assistant to submit false, misleading, or malicious information.
• You must not attempt to manipulate, jailbreak, or misuse the AI system.

5. Acceptable Use

You agree to use our website and services only for lawful purposes and in a manner consistent with these Terms. You must not:

• Violate any applicable local, national, or international law or regulation.
• Attempt to gain unauthorized access to any part of our systems, servers, or databases.
• Transmit any unsolicited or unauthorized advertising, spam, or promotional material.

8. Consultations and Appointments

Consultations scheduled via our website or AI chat assistant are subject to the following:

• All consultations are offered free of charge as an initial discovery meeting.
• Appointments are available Monday through Friday, 8:00 AM to 6:00 PM Central Time.
• We reserve the right to reschedule or cancel appointments with reasonable notice.
• A consultation does not create any obligation on either party to enter a business relationship.
• Any proposal or quote provided during or after a consultation is subject to a separate written agreement before work commences.

9. Disclaimers and Warranties

We do not warrant that:

• Our website will be uninterrupted, error-free, or free of viruses or other harmful components.
• The results of using our services will meet your specific requirements.
• Information provided by our AI assistant is accurate, complete, or up to date.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Arkana Tech and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising from:

In no event shall our total liability to you exceed the amount paid by you (if any) for services in the twelve (12) months preceding the claim.

Any dispute arising from or related to these Terms or our services shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Nashville, Tennessee, in accordance with the American Arbitration Association’s Commercial Arbitration Rules.

You agree to waive any right to a jury trial or class action proceeding in connection with any dispute related to these Terms.

13. Termination

We may terminate or suspend your access to our website and services at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms.

Upon termination, your right to use our services immediately ceases. Sections 6 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and 12 (Governing Law) shall survive termination.
